I chose to split it three ways per the terms of my her Will and got hit with the tax liability. I sure as hell don't ever expect to see them pay me back but I do feel they owed their share of the taxes. It was the way it was written. She should have been told to list three beneficiaries, then it would have been split three ways and each of us would have assumed tax liability. Mom didn't know to do that. About the time that my mother was going to sell her house my younger brother had retired and wanted to move back to town. He thought it would be a mutually beneficial deal for him to buy the house. Not a major problem,even though he thought since she was selling it to him she should discount the price. Then, since he expected to inherit an equal 25% share of her estate, he should only have to pay 75% of the price, That was where it stopped being fair. She was buying a condo and needed the money for her new home. Who knows how long she could live on her own. There was a chance that she could end up having to sell that and moved into a home of some type. She would likely need some of the proceeds of the sell to pay for her care. If it turned out to be really expensive and she hung on for a long time it could have take a huge bite out of her resources and that would have reduced the estate that my other two brothers and I would share. There was also the chance that her condo would soar in value and the other three of us would end up getting much more. I would not be surprised if, when realizing how much more we got than he, he might expect us to share some of that windfall with him. To be honest, I would consider him to have already had his share. |

Prior to that I talked to at least seven agents via the phone at the IRS (in one phone call!) about this issue before I filed the Estate taxes. They were all very helpful and understood my questions. Each tried to find a way to make them file on their share. Unfortunately the tax code isn't written that way. It all came down to the beneficiary listed on the annuity. I was responsible even if I distributed the money to my siblings. I cannot go back and change a settled estate now. The IRS doesn't consider it "undeclared income". Done deal. Oh well. Jill |
