It's certainly illegal in FRANCE to do that, yes. Actually,
I believe the French (and European, in general( law says that
you can't call it "champagne" unless it comes from the
Champagne region of France. But at least Wikipedia
claims that the U.S. and Canada legally consider
"champagne" to be a semi-generic name for a type of
sparkling wine:

I think their biggest crime is using a sound alike name that can be
easily confused with a well known California winery. Sterling
Vineyards should sic their lawyers on them, pronto.

You can call it whatever you want - but it is a protected name, just
like Bourbon is and dozens of others.
