That link doesn't work for me...but as a Personal Chef, I can tell you
it's illegal to prepare food in a home kitchen for re-sale unless that
kitchen has been approved and inspected by the health dept. or unless
the food is prepared in a commecial kitchen and then delivered.
Personal Chefs use the clients' kitchens exclusively. We cook in
house, and the food is stored in house. I can't even take my own home
grown herbs to my clients' houses.

Not exactly "home cooked" is it :-)
There is a guy in our town who prepares takeout dinners in his house. He used to
run a nice restaurant in town but had to shut it down due to a heart problem. It
was sad to see him go because he had great food at reasonable prices, choice of
freshly made soup or salad (a nice one not just a crummy tossed salad, choice of
entree, dessert and coffee for $20. After he recuperated a bit he started doing
the take out dinners Friday and Saturday evenings. He emails the weekly menu to
his regular customers. Just tell him what you want and what time you want to pick
it up and it will be ready. It's a small menu, two choices of appetizer, 2 main
dishes, dessert of the day. The main dishes sell for $8-12. We have taken
advantage of this several times. He is three minutes away by car. I can order
dinner for 7 pm. leave the house at 6:55 and be home at the dinner table by 7:10
with a nice meal.

I have wondered if what he is doing is legal. Probably not. I have been in his
kitchen. It is very clean. He does it only two days a week and the meals are
ordered ahead of time, so it's not like perishable foods are sitting around in
there. I just wonder how long it will be before one of the neighbours complains
about the traffic on Friday and Saturday nights on that otherwise quiet
residential street.

kitchen sanctioned by the health dept., and is selling his meals from
his own (uninspected?) kitchen, he is indeed in violation of most
Health Dept. Codes in most states. Note I said "most." I don't know
where you live. If he owned a restaurant, it's slightly suprising to
me he doesn't know this. But it's also possibly comforting he keeps a
clean kitchen and knows enough about ServSafe and sanitation not to
poison people. All in all...he's breaking the law.

Also...his house has to be zoned for business. Or the neighbors could
report him and he'll be shut down on two violations...maybe more when
they see his kitchen. "Clean" is never "clean enough" for the Health
Dept. I hope he's put money aside for all the fines!
