Tiffany sues Costco over sales of engagement rings

February 14, 2013 5:25 PM ET.

(Reuters) - Tiffany & Co sued Costco Wholesale Corp on Thursday to
stop the largest U.S. warehouse club chain from selling what it called
counterfeit diamond engagement rings bearing the luxury retailer's
name.

The trademark lawsuit filed in Manhattan federal court also calls on
Costco to forfeit profits from the ring sales, plus damages of $2
million per infringement.

Tiffany said it believes hundreds, if not thousands, of Costco members
bought engagement rings they believed were authentic Tiffany products
but in fact were not.

Luxury retailers often sue to stop sales of alleged imitation products
they believe cut into their own revenue streams and customer goodwill.

"This is not the kind of behavior people expect from a company like
Costco, and this case will shed a much needed light on this outrageous
behavior," said Jeffrey Mitchell, a lawyer for Tiffany.

Mitchell also noted in the statement that Tiffany maintains an
"aggressive and rigorous intellectual property program, and regularly
takes actions against counterfeiters and infringers."

A spokesman for Costco was not immediately available.

In November 2012, a person who was shopping at a Costco in Huntington
Beach, Calif., complained to Tiffany that she was disappointed to see
Costco offering for sale what were promoted on in-store signs as
Tiffany diamond engagement rings, according to the lawsuit.

A subsequent investigation revealed rings in a display case at the
Huntington Beach Costco labeled with the Tiffany brand and that a
salesperson there referred to them as Tiffany rings when they were
not, according to the lawsuit. Tiffany also discovered that Costco was
not using the Tiffany trademarks online for the same products at the
same time to avoid detection, according to the lawsuit.

The case is Tiffany & Company and Tiffany (NJ +0.35%, news) LLC v.
Costco Wholesale Corp, U.S. District Court, Southern District of New
York, 13-1041

I've only ever been to Costco once. They opened one in Cordova TN and I
was given a gift certificate. I didn't venture too far into the Costco,
just bought some books.

They sell jewelry? Costco strikes me as a 'warehouse'/Sams Club/ big
box type store... only an idiot would think Costco sells *authentic*
Tiffany jewelry.

On their web site currently, they have a diamond ring priced at
$212,000. http://www.costco.com/ Costco sells a lot of stuff
(authentic) in the store, not just limited to jewelry. It will be
interesting to see what happened here.

Yes, they sell jewelry and other nice (brand name) things.
Apparently, someone forgot to say "Tiffany Style" on their sign and
the greedy Yahoo's who thought they were getting a Tiffany anything at
a steep discount are crying foul now. If it was sold with a Tiffany
blue box, then I'd say they were actively deceiving the public.
However, I don't spend thousands on discounted jewelry at a big box
warehouse; but maybe I'm the peculiar one.

Costco also gets in independent jewelry sellers from time to time. They
put a separate table and sell their own wares. That is the only time I
have seen a salesperson associated with the sale of jewelry. My guess
it is one of those craft sellers that is doing the alleged
mis-representation.

Costco still has a responsibility to police the activity since it is on
their premises and under their auspices, but they would not directly be
doing the mis-representation. That would also explain why it is not
part of their online catalog.

I am surprised that Costco would pull this trick - how many stupid buyers do they think are out there? What customer would think that Tiffany would allow this? I guess some people believe anything.

I'm glad that woman alerted Tiffany and Co. Meanwhile, I'm going down to Joe's Used Car Lot and look for a genuine Rolls.

By the way, if you're taking a cruise, pack lots of baby wipes, nonperishable food and flashlights.

That makes sense to me. Not knowing what the real situation was, I'll
go along with your theory for the moment. Lawyers would love
having me on a jury, because I'm a sucker for a good argument.

Most of their jewelry is so out of my price range, I didn't bother to look
at it. Once in a while they'll have some company in that sells cheaper
stuff. Like around Mother's Day. They also sell some designer clothing,
handbags, etc.

What happened is that both companies got a lot of publicity. Costco
jewelry sales will probably double now, and so will Tiffany's.

Once in a while I wind up really hungry at Costco and I am happy to
get my $1.50 hot dog and drink. I'm sure there is something I'd be
happy to wash it down with, even a Pepsi.

I go to Costco for a lot of things, jewelry isn't one of them.
Still, I do love jewelry and I've noticed they have really nice
looking stuff. I wouldn't hesitate to buy from them.

So ... is Lipton a Coke brand? I had the idea that all the drink
products from those dispensers are pretty much owned by Coke or Pepsi,
whichever cola product is featured.

Ditto. I just need some kind of liquid to wash down my food, water
would be fine.

I happened to notice once that the bottled water from the vending
machines was dirt cheap compared to all other places.

Speaking of hand bags at COSTCO. I bought one a few years ago- don't
remember the brand- about $50. The inside lining kept tearing and I'd
sew it up and just imagined I had too much stuff in it. Then I
noticed a friend had the same bag. She bought hers at Macy's. Well,
it turned out to have a whole different lining. I suspect that
although I love COSTCO, manufacturers don't always sell the same
quality to COSTCO and Macy's. Of course I assumed there was a price
differential but I did not ask my friend.

Just my $.02.

Nor do I. It used to be interesting to go through the video store and
seeing the star vehicle movies that were available. There are a number
of actors, who, like Julia Roberts, seem to be cast solely for that
strange star appeal. Some people will watch any piece of crap movie with
those stars in them. She is right near the top of the list of actors who
movies I am more likely not to watch.... because they play the lead roles.

I have to agree with him. I am not even sure what it is about her that
is so appealing.... but it does appeal.

enough action to keep hubby interested and not enough violence to turn

FYI: Macy's jewelry is a rip off. CostCo sells their products at 15%
above cost. They make their money by selling memberships.

Andy is missing and I don't think the Costco snack bar has anything I could
or would eat. I guess technically I *could* eat a hot dog. But blech. I
would meet up with Andy there though. If he were here. Which I*sniff* he
is not.
