The DH, as some of you may recall, is a bankruptcy lawyer (commercial
not personal). I received the following from one of his colleagues in
email this evening. I haven't vetted it personally, but the source is
very reliable:

Default Sorta OT Store Closings and Gift Cards

I used up the last of my Mervin's gift cards in September without a
problem, but this week my SIL's gift card was refused at the register.
The local stores figure to close their doors after December 31st.
Liquidators are in and, yes, a la Linens and Things, they are raising
prices and refusing to honor sale prices on items already advertised as
on sale or clearance.

Linens and Things is taking online orders and allow gift cards for those
purchases. Mervin's may be doing the same.

Also, she said to be wary of warranties from the store or manufacturer
because bankruptcy could nullify them. This could apply to previously

Wayne, it was many years after you were in Memphis but the Mall of Memphis
was the largest shopping mall they ever had. It even had an indoor ice
skating rink. Dorothy Hamill performed on that rink when the mall opened !
It was two levels and had tons of stores. That may not sound like much to
some people but for the time, in Memphis, it was a big deal. You could buy
anything you wanted. Remember the old store (not local) Spencer's Gifts?
You could buy gag gifts and all sorts of useless crap there. It was fun!
Well, the Mall of Memphis shut its doors in 2003 (on Christmas Eve, no
less).

Well, the Mall of Memphis was razed. The DMV tried opening a small
substation there first so people could take driving tests in the parking
lot. That didn't last long. I think the fact that they had several
shootings and erected guard towers had something to do with its demise. LOL
I don't know if there is anything there now other than a vast empty parking
lot.

Meanwhile back at my "current" ranch the Hilton chain is throwing up more
hotels around Beaufort. Yeah, just what we need down here in a nice
peaceful place... tourists and more traffic. Heh. I guess those tourists
don't realize there are only two bridges and one of them (the Woods Bridge
from downtown Beaufort) was shut down due to mechanical problems causing one
hell of a problem for people who live and work here.

At least the people here fought the good fight against getting another
WalMart out in this direction. As one concerned citizen was quoted at a
city coucil meeting (I'm paraphrasing because this was months ago and I
can't find the quote) "You get all 25 checkout lanes at the existing WalMart
manned and people standing in line at all of them. Then we'll talk about
putting in another WalMart." Good answer!

Now the same developer wants to put in a Dollar Store. Okay, I love my
dollar stores. As long as it doesn't take up 295,000 sq. feet and clog
traffic. But that's still not what the property is zoned for.

That's why stores love them, it's free money. Better yet if
they can chip away at the amount with fees, it's all good.
Unless you're the one just carrying around the card and not
using it.

I think Consumer Reports is trying to get a law passed where
the store has to set aside gift card income so that if they go
bankrupt, the card holders will be paid.

Yes, they need to stand behind their zoning. They beat out Wally World
(WalMart). I hardly think a Dollar General is necessary. I can point out
where a Dollar General, a Family Dollar and Dollar Tree are located and I
don't even live here. We don't need another friggin dollar store. I
complain sometimes about having to go so far to shop for groceries. But I
don't want this place turned into another metropolis. It's peaceful here.
It's quiet here. There's little crime here. Bring in the malls and the
fast food restaurants and BOOM the next thing you know this is not a nice
quiet area.

There's a large strip mall in town that underwent a new parking arrangement a
couple years ago. Once finished, it instantly became the worst parking lot on
the planet!!! Stores come and go all the time.

claiming this story to be fake.

I just saw a documentary about Wal-Mart. Maybe you've seen it?

"Wal-Mart: The High Price of Cheap Labor."

They're a terrible company. Highly discriminatory and working foreign
factory employees seven days a week for pennies an hour, as well as
demeaning intimidation and false job growth promises to employees,
manipulating supplier prices, undercutting local competition out of
business, gross environment negligence, etc.

It was difficult to watch, with upper management smugly refusing to admit
the unfair practices it employed!!!

At the end of the program it showed a town meeting that voted Wal-Mart
outta town, denying them a building permit. Then the closing credits rolled
a list of hundreds (?) towns and cities that also voted Wal-Mart out of
town.

There's a Wal-Mart a few towns away from me that is in absolutely the
poorest part of town. I don't know by choice or not. I shopped there
exactly once. Never again, ever!

estate leases and union agreements.

And even when people do redeem the cards, they often spend their own money
once in the store (i.e., go over the gift card amount)...

Jill, that entire store is really sad. I wish for yesteryear! Even now
there is rampant building of commercial retail and office space in the
greater Phoenix area. In the 8 years we’ve lived here, I can’t even count
the number of orange, date, and pecan groves that have been obliterated for
the sake of “progress”.

Gordon Segal, the founder/owner of the Crate & Barrel chain, was on the
local PBS _Chicago Tonight_ news show last night...he made the point that
the US has been *way* "over - stored* for years now and that a big shake -
up will be coming. He was sanguine about the topic, saying that the stores
that focus on good service and value for their customers (whatever market
segment is targeted) will likely survive...

He mentioned that in our capitalist system there are highs and lows, and
these are often driven even higher and lower by extreme emotionalism...

One problem is that the US economy is hugely driven by retail spending, more
than most any other developed nation, and much of this spending is
predicated on credit spending, soooo...

In contrast to the "glass half - full" of Segal, Larry King featured Power
Lezbian - Financial Guru Suze Orman, who was yelling "Of course gas prices
are DOWN...NOBODY has a JOB to drive to...!!!". What an idiot...

One of the hospice nurses keeps urging me to go to WalMart to buy things.
She's obviously a WalMart proponent. I said, "You are just bound and
determined to make me go to WalMart, aren't you? Let me tell you right now,
I despise WalMart!" She laughed. I was deadly serious. I think she
probably buys groceries there Oh goody, saline injected meat!

The DS - a marketing major - explained this to me while at Target a
couple a weeks ago. It was strangely quiet. This particular store is
usually VERY busy. I don't remember the technical term for each type of
store but Target is one kind and WMart or dollar stores are another -
very obvious - I know. But, in tough economic times people flood the
cheaper stores.

We also stopped shopping at WMart a few years ago. My sil worked there
briefly and was treated like crap. It's just an evil, evil company.
The one thing I miss though is the cookie tins at Christmas time. They
were like a buck each. I could use a new source.

Some of this information is on the front page of the business section of
the newspapers. And all bankruptcy filings are public information.
Trust me, if there was insider information, it was long before the news
releases went out to the papers.

Hell.. even AOL had it on their front page a month or more ago.
And every financial guru I have ever read for a few years have always
discouraged people from those gift cards because they are fraught with
fees, declining value, deadlines to use, etc.

At Christmas, we usually buy Simon Mall gift cards for our attorney
service, deposition service, secretaries, other support staff, etc.
They could only be redeemed at Simon Malls. This year we bought
Visa-backed gift cards through the Simon Mall concierge at the Shops
of Mission Viejo, but they can be used anywhere.

Some stores do, but not all. Tweeter extended the deadline for redemption
but after that, you're screwed. People that put a deposit on items lost the
deposit as it is tied up now in the bankruptcy and may never get anything as
a creditor.

I misplaced it for about 18 months or 2 years, but it was redeemed
at full value, no fees or expiration.

Of course, but it seems plenty of people don't. I just saw a
mall gift card ad, you read the fine print it says they take $1.50
right off the top.

I see enough outraged letters bitching about the fees to know
they do exist. Perhaps not so many as there used to be as
people are wising up to that game. Of course, I don't live in
Connecticut. Every state has their own laws on the subject.
