LG If you paid for it by credit card, you have some options. Read the agreement you signed when you opened the account, contact the customer service department at the card company, or check the back of your most recent statement for information on contesting the charge. I would call Pennzy's and tell them if they don't rectify the situation that you will contest the charge with your credit card company. Most likely they will replace the order. If not, follow through with your contest. It won't be simple or quick, but at least you will be doing what you can. If you have the tracking number, you can go to the UPS website and trace all the steps in the delivery. You may need to supply that information when you contest the charges. |

Absent a signature of receipt from you the dispute over the allegedly undelivered merchandise is between Penzeys and UPS... inform your credit card company (if that's how you made payment) of the dispute and they will withold debiting your account (you may need to do this in writing). Chances are UPS attempted delivery and for whatever reason you didn't get to the door quickly enough (yeah, I know, some drivers give you all of twenty seconds). What you've described happened to me numerous times; the company will place a tracer on the order and in the case of Penzeys they will during the interim send out another order... I don't believe your story about Penzey's not making good. And I will assume you are an adult, so do the adult thing and stop whining like a spoiled brat. ---= BOYCOTT FRENCH--GERMAN (belgium) =--- ---= Move UNITED NATIONS To Paris =--- Sheldon ```````````` "Life would be devoid of all meaning were it without tribulation." |

If that is happening a lot you might consider just calling UPS with the tracking number and telling them you are leaving it on your front steps for pickup and correct delivery, and let them know that you will be calling the intended recipient to expect delivery. And/or report it to customer service on the website. If that happens a couple of times the driver will be more careful! Frankly, if I lived at 133 ABC and that happened more than once, I'd let the companies involved (sender and UPS) know! Sue(tm) Lead me not into temptation... I can find it myself! LG UPS is famous for saying they either delivered or tried to deliver something. I called their bluff once and from then on have always gotten my packages on time. Granted, this isn't food stuff but same principles apply. I had ordered a router for my network at home. I expected it to come on a certain day and was home all afternoon. The doorbell never rang and I know that as of 2PM there wasn't a tag on the door to the building. Finally at about 6PM I go downstairs and there's a little yellow UPS tag on he door. Huh? I test my doorbell - it works. My next call was to UPS - told them I had video surveillance set up and the driver never rang my bell, just stuck the notice on the door. I told them I wanted the package by 8:30AM the next morning, no question. I got my package at 7:55AM. UPS does in fact work their employees to the bone. In many cases the trucks are so overstuffed that there isn't any way possible that they could deliver all the packages in a given day. So they segregate residential packages and write up the yellow tags, it's alot faster to just slap a tag on a door than to deliver the actual package. I caught them at their own game. It sounds to me like your driver is snagging packages destined for you. Might want to see if you can find an inexpensive video recording solution and monitor your front doorstep. Or send yourself an empty package (Weigh it down) via UPS from some fictitious company. Then sit home all day and watch. I find that USPS does a much better job delivering small packages than UPS ever could. For example, my mailman knows to deliver my packages to the restaurant below me. They put the package right beside my door inside the building. UPS on the other hand makes deliveries to both places but never thought of that. I refuse to use Brown aka UPS for anything if I can help it. Frankly, I don't know why anyone would choose UPS over FedEx Ground. I ship anywhere between 25-150 packages a week, and FedEx has been cheaper, and more reliable all the way. Granted they get pricey with the express items, but 95% of what I ship goes ground, and it is dirt cheap to ship, and when they lose something and you have to file a claim it is done in a week, not 30-90 days like UPS. kimberly |

Call the credit card company. I've only had problems once with UPS - they put a notice on my door stating "2nd delivery attempt". Excuse me? I never got the "1st delivery attempt". I put a note up with that notice stating when they should deliver it. The next day I got the "3rd and final delivery" attempt notice, which was really the 2nd attempt and the driver ignored my note completely. I did get my package, however I had to drive to the UPS center to pick it up which was most inconvenient. It's a thankless job; one I wouldn't do. I see the UPS guy and the FedEx guy at work, loaded down with boxes and packages. It's amazing they still have smiles on their faces. But they are both friendly guys and always take time to say hello ![]() Jill |

I eventually tracked down my package -- UPS delivered it to my house number, but one block west of my street. It took more than a month to find it. The householder had simply left it on her cluttered porch unopened; one day I went past the house and it looked like moving day, so I knocked on the door and when I found that the lady's children were helping her pack up to move, I convinced them to take a look for it. --thelma : LG |

For starters, you're going to have to prove the merchandise was not delivered. Bullshit. In the case at hand the customer has to prove nothing, nada, zip! Obviously the transaction in question required no signature by the recipient, therefore the only parties in dispute are Penzeys and UPS. The customer received no product therefore owes nothing, nada, zip! Absent a signature requirement the onus of proof is wholey upon Penzeys and UPS that the customer recieved the product... only Penzeys and UPS contracted to make delivery, the customer is absolutely no party whatsoever to the delivery contract. The only circumstance making the customer responsible occurs when the customer is obligated to sign for delivery AND in fact does so... *no ticky no shirty*. Vely simple. ---= BOYCOTT FRENCH--GERMAN (belgium) =--- ---= Move UNITED NATIONS To Paris =--- Sheldon ```````````` "Life would be devoid of all meaning were it without tribulation." |

This is probably not the desired response - but peaked my interest and I
went to their site and ordered a catalogue. Are their spices superior? Not the usual run of the mill stuff that I might get in a local supermarket. If so I might consider ordering. Love Indian food or anything different. But not too hot since I find the heat drowns the flavour. Any suggestions for a first time buyer? E. "Dog3" dognospam@adjfkdla;not wrote in message 4... LG For starters, you're going to have to prove the merchandise was not delivered. I can't imagine Penzey's not doing some type of investigation. I assume you paid by credit card. Call the credit card company and explain the situation. They will stop the payment to Penzey's. You might have to write letters to get this all accomplished. Meantime, check your tracking number online and see if the package is shown as delivered. If UPS states the package was delivered, Penzey's has no reason to believe otherwise. I still can't believe Penzey's will not at least investigate it. Michael -- "The carp was dead, killed, assassinated, murdered in the first, second and third degree. The credit card company makes its money from the seller, not the buyer. I recently had a hassle with a moving company that (grossly) overcharged me. I paid with a MasterCard. Eventually I got a refund on the order of fifteen hundred dollars. Initially, I assumed that the money came out of the moving company's hide, but no. It was sent to me by the card company with little more than a mention to the "seller." -- Kenneth If you email... Please remove the "SPAMLESS." |

Their website is informative and chatty and their occasional catalogues are full of info and recipes. If you haven't ordered yet just browse all of the food areas you love. They pretty much have it all, and with (at least to me) very fine service. Don't understand this problem but that obviously it is UPS' fault. pavane |

I'd really check to be sure it was delivered to the right house and the right street. I've had a horrible time with UPS in the past, *attempted delivery* uh-huh...home and no one ever knocks on the door or rings the bell. Jessica |
